"The odd thing about the Punisher: he and characters like him work best when in an established moral framework. Anti-heroes do not work as well when there is not the 'Hero' to contrast them against. "Batman and Superman have a similar dynamic IMHO. You could argue that Cyclops and Wolverine are somewhat similar in that regard. Thomas Jane's version of the Punisher worked because you're seeing him change from Lawful Good to Chaotic Good throughout the movie. You also have Rebecca Romjin's character as well as his other neghbors anchoring him to the "Good" side of the spectrum. I'd argue he was less of an Antihero than the comic book Punisher."
